Claims for compensation over the depreciation of homes in the Heron Forstal Avenue area of Hawkinge are now being considered by Kent County Council (KCC) according to land compensation consultant Barrie Wood.

KCC will be looking at factors such as traffic noise arising from the use of the first phase of Spitfire Way, between the A20/A26 roundabout and the new roundabout at Haven Drive/Swann Way.

Mr Wood had lodged the claims on behalf of a number of residents earlier, but they could not be acted upon promptly because the new road had not been adopted within three years of opening, as required by the Land Compensation Act Part 1.

Several householders referred their cases to the Local Government Ombudsman who considered that the claimants had been disadvantaged.

A letter from the Local Government Ombudsman stated that KCC are now inviting original claims to be resubmitted. These are to be considered in the normal way and negotiations will take place to decide the amount of compensation.

Mr Wood has confirmed that he has now also lodged claims from residents affected by the final phase of the Spitfire Way link road.
