'Problems with dog fouling and a general deterioration of the whole area

Re: Access to popular footpath blocked by council

I am writing in response to a piece posted by Peter  regarding the 'well used footpath' and would like to correct several misconceptions regarding this issue:-

1 There never has been a footpath along this stretch of land, nor a public right of way, nor a public thoroughfare.

2 The area fenced off was designated as a buffer strip by the planning department - the relevant planning consent can be viewed at the council office by anyone interested enough to make the effort. It should have been, according to the consent, densely landscaped.

3 Over the years, more and more people have used the land outside this fenced off strip for walking their dogs etc.

Gradually over this period of time the fencing was broken down in a number of places, allowing 'unauthorised' access to the strip. This resulted in problems with dog fouling and a general deterioration of the whole area.

4 Whilst this was going on, the majority of walkers continued to use the area outside the fence with no problems, and this is true to this very day. There has been no destruction of a 'good amenity' for anyone. As that land outside the fence belongs to KCC, presumably it is up to them how their land is treated.

5 The fenced off buffer strip is owned by Shepway District Council and they have simply confirmed their ownership and are trying to return the area to what it was originally designated as - a densely planter buffer strip between the houses and the bank leading to the road.

6 The resident affected by this issue are in complete agreement with Shepway District Council in their actions to improve the condition of the land, and are working with the council in maintaining it.

Several points in Mr. Cameron's comments are beyond dispute but others need challenging.

1.It is true that there has never been a public right of way nor a legal thoroughfare. However there has certainly been a footpath for at least 10 years whose use up to this year had been encouraged by SDC who mowed the route.

2. I have no doubt that Mr. Cameron's statement about the plans is true.

3. Would the Camerons deny that they have used 'unauthorized' access to this area via their garden gate? Deny that they have excercised their dogs here and continued on towards Killing Wood? Would they also claim that their two lovely but large dogs have never fouled the area?

4.The majority of walkers have not used the area outside the fenced area. The way next to the fence is extreemly rough and often blocked with garden debris. The top of the bank is overgrown, rough and will become blocked as the dense planting of the bank(which includes rambling roses, holly and other pricklies) continues to grow. This route is currently having enforced use by those physically able and there are plenty who cannot manage this. I have used the bank once. My dog objected to the prickles and nettles and now refuses to go up there.

5.This is related to issue 1. and many hope that SDC will review their policy.

6.Some residents backing onto this area claim that they were not consulted and were surprised to find themselves fenced in. Hawkinge residents of the wider community affected by this exclusion are not in agreement with SDC's action and are hoping that they will be consulted and the matter reviewed.
